Terms of Service
These Terms of Service govern your use of VotumVela. By creating an account, browsing a shared list as a guest, or using the VotumVela browser extension, you agree to these terms. If you do not agree, please do not use the service.
Eligibility and Your Account
You must be able to form a legally binding contract to create a VotumVela account. You are responsible for the accuracy of the information you provide and for all activity that happens under your account, including keeping your password confidential. Let us know right away if you believe your account has been accessed without your permission.
The Service We Provide
VotumVela lets you build and share wish lists, coordinate gift-giving for events and other people, and browse a marketplace of gifts from independent sellers. Coordinators, co-owners, and event organizers may be given access to information and actions on a list as described in our Privacy Policy. We may add, change, or remove features as the service evolves.
Links to Retailers
Most items on a VotumVela wish list link out to a third-party retailer's own website, where the purchase actually happens. VotumVela is not a party to that transaction -- the retailer's own terms, pricing, availability, and return policy apply. We may earn a commission when you purchase through these links; this does not affect the price you pay.
Marketplace Purchases and Sellers
Items sold through the VotumVela marketplace are listed and fulfilled by independent sellers, not by VotumVela. Sellers are responsible for the accuracy of their listings, for shipping items as described, and for complying with applicable law. Payments are processed by Stripe; by selling on the marketplace you also agree to Stripe's own terms for connected accounts. VotumVela facilitates the transaction and retains a commission, as described at checkout.
Browser Extension
The VotumVela browser extension is provided to make it easier to add items to your lists while shopping. It only reads information from a page and contacts VotumVela when you actively choose to sign in or add an item. You are responsible for keeping the device it is installed on secure. See our Privacy Policy for what the extension collects and sends.
Child Profiles
A child profile may only be created and managed by a parent or legal guardian using their own VotumVela account. The parent or guardian is responsible for all activity on a child profile, including any PIN-protected session used to view or add to that child's list.
Acceptable Use
You agree not to use VotumVela to harass or defraud another person, to post content that is illegal or infringes someone else's rights, to attempt to bypass the platform's security or access controls, or to use the service for any purpose it was not designed for. We may remove content or suspend an account that violates these terms.
Content Safety
VotumVela has zero tolerance for child sexual abuse material (CSAM). Every image on the platform, whether uploaded by a user or cached from a linked product, is screened by PhotoDNA; a confirmed match is reported to the National Center for Missing & Exploited Children's CyberTipline as required by 18 U.S.C. 2258A, and the associated account may be permanently suspended and referred to law enforcement.
Intellectual Property
The VotumVela name, logo, and platform design are owned by Fire Horse Software. You retain ownership of content you add to your lists, such as notes and honoree details, and you grant us the license needed to display and operate that content as part of the service.
Suspension and Termination
You may close your account at any time from your account settings. We may suspend or terminate an account that violates these terms, poses a risk to other users, or is required by law to be removed. Some records may be retained after closure for legal, security, or fraud-prevention purposes, as described in our Privacy Policy.
Disclaimers and Limitation of Liability
VotumVela is provided "as is." We do our best to keep the service accurate and available, but we do not guarantee that a linked retailer's price, availability, or shipping will be correct, or that the service will be uninterrupted or error-free. To the extent permitted by law, VotumVela and Fire Horse Software are not liable for indirect or consequential damages arising from your use of the service.
Changes to These Terms
We may update these terms as the service changes. We will update the effective date above when we do, and material changes will be communicated the same way we communicate material Privacy Policy changes. Continuing to use VotumVela after an update means you accept the revised terms.
